Genentech’s Levinson quits Google, as feds probe Apple’s board

Facing a federal conflict-of-interest probe, Arthur Levinson, chairman of biotech giant Genentech, resigned from Google (GOOG)’s board on Monday. The move comes nine weeks after Google CEO Eric Schmidt left the board of Apple (AAPL), where Levinson also serves. The presence of both men on Apple’s board had prompted a Federal Trade Commission investigation, launched in May, over whether Schmidt and Levinson’s board service violated federal competition rules.
Google and Apple, two tech powerhouses often seen as allies against Microsoft (MSFT)’s domination of the operating system and browser market, are moving closer into direct competition now that Google is striding forcefully into the mobile phone fray with its Android open-source mobile-phone operating system.

New Michael Jackson song debuts online

Well, that didn’t take long: The King of Pop has been gone for less than four months, and an unreleased Michael Jackson track is already available online.
This Is It features backing vocals from Jackson’s brothers. According to Bloomberg, “The single was planned as the theme of Jackson’s sold-out “This Is It” concerts that would have started this July in London’s O2 Arena.”

Home foreclosures move up-market as discounting pushes prices down

A greater number of foreclosures are hitting the high-end real estate markets in 2009 as price discounting continues to throw more and more properties underwater. It’s like a self-fulfilling prophecy: As some homeowners see their homes’ values drop below the balances due on their mortgages, they give up trying to save their homes.
Zillow’s chief economist, Stan Humphries, found that while high-end markets accounted for only 16 percent of foreclosures in 2006, by July 2009, 30 percent of foreclosures hit the top third of homes. “That means that top-tier homes make up almost twice the proportion of foreclosures as they did just three years ago,” Humphries wrote on his blog.

It’s a ghoulish business writing about the health of public company CEOs. Nobody likes facing illness, but even with their immense wealth, top executives all end up in the same place as every other person born on this planet.
Boards of directors at public companies are supposed to comply with disclosure laws to protect shareholders when their CEOs suffer illnesses that keep them away from their work. Unfortunately for shareholders of Lazard Ltd. (LAZ) and Apple Inc. (AAPL), the boards at these companies may be ignoring the spirit if not the letter of the disclosure laws.
